Relationship Property         

Relationship Property law deals with the property rights of married, de facto or civil union couples during a relationship, upon separation or when one of them dies. Relationship property laws generally apply to all married, civil-union and de facto couples who have been in a relationship for three years or more.

We can advise you on your rights.  Our Family Law specialists can provide advice at the beginning or during a relationship and in regard to asset structuring prior to even commencing a relationship.  Couples may want to keep particular property or contributions to property separate or to provide that property remains for the benefit of children from a previous relationship.  Following the end of a relationship our specialists can also provide advice about property rights and help you to achieve a good property settlement, by agreement or by litigation.

                                           

Contracting Out Agreements            

You and your partner can reach your own agreement about how your property will be divided if you should separate in the future.  A Contracting Out Agreement will identify your property rights clearly and preserve the ownership of assets you or your partner wish to keep separate.  We will help you to reach an agreement that is right for you.

Family Dispute Resolution Services and Mediation        

With almost all family law issues, going to court is the last resort.  If it is necessary in your case we have the expertise to guide you through the process.

In March 2014 the Family Court changed.  In most cases involving children people will go through a compulsory Family Dispute Resolution process, involving mediation and counselling before going to Court.  In these cases, unless there is urgency or issues of safety you will not be able to have a lawyer represent you in Court at the start.  Therefore, getting expert advice at the beginning will be essential, enabling you to fully understand and prepare for the mediation and court process.  We can help you prepare the necessary court documents and continue to provide legal advice as your case progresses.
