Resource Management Regulations 2017

The Resource Management (National Environmental Standards for Plantation Forestry) Regulations 2017 (“NES”) will come into force on 1 May 2018. The rules in the NES will generally override the rules in district and regional plans.

Under section 44A of the Resource Management Act 1991 (“RMA”) local authorities must amend rules in their regional and district plans that conflict with rules in the NES. They do not have to follow the usual consultation process under Schedule 1 of the RMA.

A rule in a district or regional plan may be more stringent than the NES in limited circumstances, such as where the rule gives effect to fresh water objectives of the National Policy Statement for Freshwater or certain policies of the New Zealand Coastal Policy Statement, or provides for the protection of significant natural areas.
